Often PEAs allow themselves to circumvent the legal provisions to the detriment of the debtor, taking advantage of their privileged position, which the law gives them.

The Act specifies in detail all acts or actions that may be subject to judicial review in case of violation committed by the PEA.

In the first place, these are explicit refusals and decrees of the PEA, which refuse to perform a certain enforcement action, as well as the suspension and termination of enforcement. The right of this appeal is recognized only in respect of the creditor, as the debtor has no interest in this appeal.

In case of contesting the actions of the PEA, the debtor may appeal the issued Decree of the PEA for a fine and directing the enforcement on real estate, which he considers non-sequestrable, confiscation of movable property or its removal from property.

Due to the fact that the execution was not duly notified, as well as due to the fact that the bidding at the public sale was not carried out properly or the property was not awarded at the highest offered price.
