What to Do When Enforcement Proceedings Are Initiated Against You?

What to do when enforcemrnt preceedings are initiated against You?

When you receive a notice for voluntary compliance (ПДИ), a summons for compulsory enforcement, or any other communication from a private enforcement officer or state enforcement officer, the most important thing is not to delay. Enforcement proceedings develop quickly and often involve strict deadlines, the omission of which may result in the loss of key defense opportunities. Even if you believe that "nothing can be done," in many cases there are procedural measures that can limit damages or halt the actions of the enforcement officers.

1) Do not act blindly

Do not rush to sign documents, acknowledge your debt over the phone, or agree to a "convenient" repayment plan before you have a clear picture. Sometimes an unintentional admission, partial payment, or improperly worded request can worsen your position. Also, do not accept as a final conclusion the general assertion that "once there is an enforcement writ, nothing can be done."

2) Seek legal Counsel immediately (Deadlines)

The safest course of action is to consult immediately with a lawyer who works with enforcement cases. The reason is that certain objections and appeals must be filed within short and preclusive deadlines, and after they expire, any subsequent actions may have no legal effect. The earlier professional help is engaged, the greater the chance of a timely and appropriate response.

Good preparation in the first few days often saves you from bank account freezes, additional fees, and escalating costs.

Why delays almost always cost more

A common mistake is for the debtor to "wait and see what happens," rely on verbal assurances, or seek a solution only after a bank account has been frozen or movable property seized. In enforcement proceedings, missed deadlines can rarely be compensated for, and in the meantime, costs and fees continue to accumulate.

A timely consultation is often the cheapest way to avoid subsequent larger losses.

Contact a lawyer immediately after receiving a notice for voluntary or compulsory enforcement, or at the first sign of a freeze or attachment. Prepare and bring all available documents, including the communications you have received (the dates of service are important), as well as information about any imposed freezes and deductions made, if applicable.

Our law firm can conduct a quick review of your documents, assess the deadlines, and propose specific steps tailored to your case.
